The Indian Government has yet again deferred the consideration of the Patents Amendment Bill. A deadline of 19/04/1999 has been set by the W T O.

  The following are the " Convention Countries"
  as per a Notification effective 28/09/1998 for the
  "claim of priority" under the Patents Act, 1970

The BIO DIVERSITY BILL appears to be still at the Draft stage and the final bill is expected to incorporate relating to seeking of permission from a Biodiversity authority before seeking a Patent in India or elsewhere so far as it relates invention based on information /research relating to a biological resource in India. The Bill is also expected to create a wide base of people, companies or corporation to be covered under its ambit.

India has acceded to the Paris Convention & PCT effective 7/12/1998.

It is expected that with reforms in the pipeline the I P position in India will be more secure.
